As new rules of the Brazilian Traffic Code are results of Law No. 14.229 / 2021, published in October 2021 and came into effect in April 2022.

Fines for overweight vehicles
The infraction for overweight, referring to cargo transportation, were made more flexible with the change in the article 99 of the Brazilian Traffic Code.
In this way, it allows larger loads without the application of fines, as long as it is within the established fixed weight limits.
The manufacturer must leave the technical weight limit per axle displayed in a visible place on the vehicle and on the revamped, respecting the form defined by the National Traffic Council (Contran).
Furthermore, the law deals with the special authorization for traffic of vehicles over the permitted weight, in specific cases. In this case, it refers to traffic in rural and unpaved areas.

Fixed fine for legal entity is among the new traffic rules
The new rules determine that companies that own a vehicle must pay extra for fines in which the offending driver is not presented or indicated.
In the case of infractions recorded in vehicles whose owner is a legal entity, the driver indication is a mandatory step. After all, the score for the infractions will be applied to the CNH of the driver presented.
According to the updated legislation, in cases where the offending driver is not identified, a new fine will be directed to the owner of the vehicle. Like this, the amount to be paid by the legal entity will be doubled.

For example, if the driver commits a violation of a serious nature, the original fine would be R$195,23, however, if there is no identification of this driver, the amount of the fine directed to the owner of the vehicle, becomes R$390,46.

Mandatory CNH suspensive effect
According to the new traffic rules, in cases of suspension or revocation, the driver cannot have his CNH blocked or be prevented from renewing the document.

Although suspension as a penalty already existed, it would only occur at the request of the driver. Therefore, while the process is not finalized, there will be no penalty for the driver.

New National Driver's License
As determined by the National Traffic Council, the CNH will also undergo changes. The new model of the National Driver's License is translated into three languages and can be replaced upon renewal or issuance of the duplicate.

There is no need to request the immediate exchange of the document, as the replacement will happen normally. In addition, the entry of a new model does not invalidate the current ones, which can be used until their expiration date.
